AAR, ASLRRA seek exemption from trucking hours-of-service rules
The Association of American Railroads and American Short Line and Regional Railroad Association have applied for an hours-of-service exemption from Federal Motor Carrier Safety Administration rules regarding drivers of commercial vehicles, seeking more flexibility for maintenance workers who may need to respond to an emergency. A notice in the Federal Register says the two associations are requesting exemptions from several rules, among them those prohibiting an individual from driving without having 10 consecutive hours off; driving after more than 8 hours without a 30-minute break; driving after 14 hours on duty; driving more than 11 hours in a 14-hour period; and driving after 60 or 70 hours on duty in a work week of seven or eight days. The request from the two associations would allow the exemption for an employee “responding to an unplanned event that affects interstate commerce, service or the safety of railway operations, including passenger rail operations, and that occurs outside of or extends beyond the employee’s normal shift.” Thursday’s publication in the Federal Register begins a 32-day period for public comment on the rule.
